CONSUMER NOTICE:

The Sharper Image lawsuit against Consumers Reports for product disparagement was dismissed in US Federal Court as Sharper Image could NOT demonstrate that any of the Consumer Reports findings were false.

In addition, Sharper Image was ordered by the US Federal Court to reimburse Consumer Reports $525,000 for attorney's fees and court costs.

Result: Infomercials and advertising for both the Sharper Image Ionic Breeze and the Oreck XL Professional air cleaners continue nationally proclaiming their "effectiveness" and inferring their health benefits even after Consumer Reports has rated both: "poor", "ineffective" and "not recommended".

Update 1/20/07:
Sharper Image Corp. has agreed to discount its high-tech gadgets (Ionic Breeze) by more than $60 million and make several other concessions to settle a class action lawsuit alleging the specialty retailer misled customers about the effectiveness of its air purifiers (Ionic Breeze).

Under the proposed settlement disclosed Friday (1/19/07) in a regulatory filing, Sharper Image will offer $19 merchandise credits to each of the 3.2 million customers who have bought one of its Ionic Breeze purifiers since May 6, 1999.

Sharper Image also agreed to tone down its advertising claims about the power of the Ionic Breeze and to pay $1.875 million in fees to lawyers who filed the suit on hehalf of Manual Figueroa in a Miami federal court.

The settlement still requires court approval. Friday's filing indicated a hearing on the settlement will be held by March 1 (2007).

Sharper Image states that it cannot afford to settle the class-action law suit brought by 27 state attorneys general and other plaintiffs regarding Ionic Breeze air purifiers not functioning as promised (advertised).
